Case Example from Karlsruhe: Heir tracing for property ownership clarification

Our client from Sarajevo, Bosnia and Herzegovina – let’s call him Mr. Horvat – had inherited a valuable property in Karlsruhe and wanted to sell it. His problem: A certain Ms. Anisa Babić was listed as a co-owner in the land register since the 1950s. Without her consent, Mr. Horvat could not proceed with the sale. Since he had no contact details for Ms. Babić and only knew that she had once moved somewhere to Germany, probably to Baden, he commissioned our detective agency in Karlsruhe to conduct a person search. The task was challenging — there was no date of birth, no former address, not even a confirmed place of residence.

No person in Germany matching the known data

Using the surname “Babić” in combination with various towns across Baden-Württemberg, our lead investigator identified several individuals who might have been connected to the missing woman. However, none could provide useful information — not even those sharing her surname. Further research by our detective in Karlsruhe suggested that no such person existed in Germany under that spelling. However, he discovered a woman whose records matched almost perfectly, except for the name spelling: in German registries, her surname appeared as “Babiz.” Was it a clerical error? This woman was born in Tuzla, then Yugoslavia, in the late 1920s, appeared in German records from the 1960s onwards (listed as “married”), and died in 2001 at an unknown location. While the place of death could not be determined, a probate file was found at the Local Court (Amtsgericht) Karlsruhe.

Result of the inheritance search: The son as sole heir

With the file reference number from the probate record, a signed power of attorney from our client, a justification letter, and a Bosnian land register extract, our investigator visited the Local Court of Karlsruhe to inspect the probate file and identify the heir. After a brief wait, the detective was invited in by a clerk, who retrieved a microfilm copy of Ms. Babić’s will. It named her son, born in 1961 in Germany, as her sole heir — the exact contact Mr. Horvat needed.

 

The probate file also included an old address in Würzburg, but according to the Karlsruhe residents’ registry, this information was outdated. The heir had moved back to Karlsruhe in 2003 and was living in the very apartment inherited from his mother.

Tracing the heir’s current contact details

A brief telephone directory search even turned up a landline number for the heir; however, when the investigator attempted to call it, he was met with the message, “this number is not in service.” Consequently, our Karlsruhe detective decided on the spot to drive to the registered address of the person in question, only a few kilometres away. He did not find him there either, as none of the doorbells in the apartment building bore his name. Through questioning the neighbours, the investigator learned that the heir had moved to the countryside several years earlier. The apartment, they said, still belonged to him but was now rented out to a family who would likely know his contact details.

 

Accordingly, the private investigator rang the doorbell of Mrs. Babić’s former apartment, but no one answered. After waiting a reasonable amount of time without the residents returning or gaining new information from further questioning, our private detective in Karlsruhe decided—out of consideration for cost efficiency—to end the operation for the time being and to attempt to reach the family later from the office using a phone number found online. This approach eventually proved successful after several attempts, though the tenants displayed understandable caution and refused to disclose the heir’s contact details.
